Climate law: the main measures and what they could change on a daily basis

The "climate and resilience" bill comes to the vote this Tuesday at the National Assembly in first reading. The text translates part of the 146 proposals of the Citizen's Climate Convention (CCC) that Emmanuel Macron had adopted.

The deputies enriched the text during the session, in particular on the energy renovation of housing, without upsetting the balance. It is intended to complement other translations of the Convention's proposals (recovery plan, budget, regulatory route).

Measurements in the daily life of consumers

Experimentation with a view to an obligation of environmental labeling on products or services, primarily in the textile industry: a "carbon score" for consumers.

Prohibition of advertising in favor of fossil fuels and "promotion" by the Higher Audiovisual Council (CSA) of "codes of good conduct" for audiovisual advertisements relating to "goods and services having a negative impact on the environment ". The CCC had for its part proposed strong restrictions on advertising on the most polluting products.

Increase in the powers of mayors to regulate advertising space, particularly on screens in shop windows.

Objective of 20% of the sales area devoted by 2030 to bulk sales in shops of more than 400 m2. Prohibition of single-use polystyrene food packaging from 2025.

Possibility of developing the deposit to reuse glass bottles, if the environmental balance of the measure is better than with recycling. In committee, however, MEPs limited the scope of this article.

For manufacturers of bicycles, lawnmowers and other gardening machinery, obligation to supply spare parts for certain products for a minimum period of five years after the end of their marketing.

For the State and communities

Reinforce the consideration of the environment in public orders.

Authorize the State to reform the mining code by ordinance.

Possibility for voluntary regions to create an eco-tax for the road transport of goods.

Evolution towards the abolition of the tax advantage on the taxation of diesel for the transport of goods by 2030, accompanied by "support for the energy transition of the road transport sector".

Objective of ending the marketing of heavy goods vehicles using mainly fossil fuels (diesel or conventional gasoline) in 2040.

Towards a new mobility?

Mandatory establishment of low emission zones (limiting the circulation of certain vehicles) by 2025 in all metropolitan areas with more than 150,000 inhabitants.

Tighter emission limits for private vehicles, with sales bans from 2030.

Extension of the conversion bonus - in the event of the scrapping of polluting vehicles - to the acquisition of electric bicycles.

Prohibition of air flights when there is an alternative by train by a direct connection in less than 2 hours 30 minutes provided several times a day (possible exceptions for journeys providing connections).

Compensation of emissions from domestic flights by companies (50% in 2022, 70% in 2023, all of their emissions in 2024).

Housing

Supervision of the rent for “thermal strainer” housing (classified F and G, i.e. nearly 5 million). From 2025 for the "G" and from 2028 for the "F", they will no longer be classified as "decent accommodation" and will therefore be prohibited for rental. The measure will apply to “E” classified housing in 2034. Energy audit compulsory in the event of sale.

Energy performance diagnosis for collective residential buildings.

Support for households for the energy renovation of their homes, and partial guarantee scheme to facilitate access to credit for low-income households (for “transfer advance” loans) with a view to renovation.

Halve the artificialization of soils compared to the previous decade, to "achieve" the goal of zero net artificialization by 2050.

To reassure the elected officials, the deputies voted for deadlines giving them time to update the town planning documents five and six years after the promulgation of the law.

Prohibition, except for derogations, of the creation or extension of large commercial surfaces resulting in the artificialization of the soil.

Ecosystems: inclusion in the law of the objective of 30% protected areas.

Even in school canteens

Generalization of a weekly vegetarian menu in canteens. Experimentation in voluntary local authorities with a daily vegetarian option and extension in 2024.

To set an "example", a daily vegetarian option will be set up in the collective restaurants of administrations, public establishments and public companies in 2023, in the event of multiple menus.

Minimum of 60% "quality" meat and fish in school canteens, from 2024, to avoid processed or imported products. Prohibition on the use of synthetic meat or from cell cultures.

Extension to private collective catering of the obligation to use 50% sustainable or fair trade products, and 20% organic.

Agriculture

If the objectives for reducing emissions linked to nitrogenous agricultural fertilizers are not achieved, it is "envisaged to set up a fee".

A new offense

Creation of a general offense of water and air pollution, with in particular the qualification of "ecocide" when the facts are committed intentionally (up to ten years' imprisonment and 4.5 million euro fine).
